Chapter 8: The Testimony That Destroyed My Trust
I read the guardianship petition three times.
My mother's name appeared on the second page.
*Margaret Bennett — Supporting Witness.*
I looked at Daniel.
"Did Mom sign this?""
He adjusted his jacket.
"She agreed that Lily deserves stability.""
"That's not what I asked.""
Tara crossed her arms.
"Your mother has seen how things have been going.""
I turned toward her.
"You've spoken to my mother about Lily?""
"Of course.""
"When?""
"Several times.""
I looked back at Daniel.
"Why is she listed as a witness?""
He shrugged.
"Because she knows you.""
I almost laughed.
My mother had spent the last two years telling me how proud she was that I had taken Lily in after Rachel died.
She had knitted Lily a blanket for her first Christmas with us.
She called every Sunday.
And now she was supposedly helping my brother take my daughter away.
I picked up the petition again.
There were several allegations.
I supposedly worked excessive hours.
I supposedly failed to provide emotional support.
I supposedly left Lily unsupervised.
And one statement claimed I had frequently threatened to send Lily away.
That last accusation made my blood run cold.
I looked at Tara.
"Did you write this?""
She looked away.
"Daniel prepared the documents.""
"Did you provide the information?""
"I answered his questions.""
"What questions?""
"Marcus, I'm not doing this.""
I placed the petition on the table.
"You're going to explain every single thing you told him.""
Daniel stepped forward.
"Let's not turn this into a shouting match.""
I pointed toward the front door.
"Get out of my house.""
He smiled faintly.
"That's exactly the kind of reaction we're concerned about.""
For a moment, I couldn't believe what I'd heard.
He was deliberately provoking me.
And he wanted someone to witness it.
I took a step backward.
"You're right. I don't want to give you another sentence you can twist into a legal document.""
Daniel's smile disappeared.
I pulled out my phone.
"Everything you say from this point forward will be documented.""
Tara scoffed.
"You're being ridiculous.""
"Maybe. But I'm no longer taking chances.""
Daniel picked up his jacket.
"We'll see each other in court.""
He walked toward the door.
Before leaving, he turned toward Lily, who was standing halfway up the stairs.
"Don't worry, sweetheart. Everything will be better soon.""
I moved immediately.
"Don't speak to her.""
He gave me one last look.
Then he left.
Tara followed him outside.
I watched through the window as they stood beside his car.
She touched his arm.
He leaned toward her.
They spoke for nearly a minute.
Then Tara returned alone.
I was waiting in the living room.
"How long have you been working with him?""
She dropped her purse.
"I haven't been working with anyone.""
"Then why is he filing for custody?""
"Because he thinks you're not handling things properly.""
I stared at her.
"And you agree?""
Tara didn't answer.
I felt my chest tighten.
"Seven years, Tara. Seven years of marriage, and you helped my brother build a case to take my daughter?""
She raised her voice.
"You make everything about Lily!""
"She's twelve!""
"And Emma is fourteen!""
I shook my head.
"Emma has never been threatened with losing her home.""
Tara's expression changed.
For the first time, she seemed to realize what she had admitted.
She turned away.
"I need to check on Emma.""
I let her go.
That evening, I called my mother.
She answered cheerfully.
"Marcus! I was just thinking about you.""
"Mom, I need to ask you something.""
Her voice immediately changed.
"What happened?""
"Did you sign a statement supporting Daniel's guardianship petition?""
Silence.
Then a quiet sigh.
"Your brother told me he was helping Lily.""
"Helping her how?""
"He said things weren't good at your house.""
I closed my eyes.
"Mom, did you actually sign anything?""
"I signed a statement saying Lily could stay with me if she needed somewhere safe.""
I sat down.
"Did Daniel tell you I was trying to send her away?""
"He said you were overwhelmed.""
"Did he tell you I was abusing her?""
Another pause.
"He said Tara had concerns.""
I pressed my fingers against my forehead.
"Mom, did you speak to Lily?""
"No.""
"Have you asked her whether she wants to leave?""
"No, Marcus. I thought you and Daniel had already discussed everything.""
I took a breath.
"Mom, Lily thinks she's going to be sent away. She believes I might stop loving her if she makes mistakes. Someone has been telling her those things for months.""
My mother's voice broke.
"What?""
I explained the dinner incident, the stolen belongings, the letter Lily had written, and the guardianship documents.
By the time I finished, my mother was crying.
"Oh, sweetheart. I didn't know.""
"Mom, I need you to tell me exactly what Daniel said.""
She sniffed.
"He came to see me three weeks ago. He said Rachel had made arrangements for him to help Lily if anything happened to you.""
"Did he show you paperwork?""
"Yes.""
"What kind?""
"Something about a guardianship agreement. He said you had agreed to it.""
I felt my stomach turn.
"I never agreed.""
"I know that now.""
"Did he mention the money Rachel left Lily?""
My mother went quiet.
"Yes.""
"What did he say?""
"He said the trust needed a responsible family member to manage it.""
I closed my eyes.
"Mom, he wanted access to Lily's inheritance.""
She started crying harder.
"Oh, Marcus.""
I ended the call only after promising to visit her the following day.
Then I went upstairs.
Lily was sitting on her bed, drawing in a notebook.
She looked up.
"Is Uncle Daniel gone?""
"Yes.""
"Is he coming back?""
I sat beside her.
"I don't know, sweetheart. But he won't be allowed to frighten you.""
She nodded.
I noticed a folded sheet of paper beside her.
"What's that?""
She hesitated.
"It's something Emma gave me.""
I picked it up.
It was a printed photograph of the guardianship petition.
Someone had circled a paragraph in red.
The paragraph claimed that Lily had expressed a desire to live with Daniel.
I looked at her.
"Did you say that?""
She shook her head immediately.
"No!""
"Have you ever told anyone you wanted to live with Uncle Daniel?""
"No, Dad.""
Her voice trembled.
"Actually, he asked me to say that.""
My heart stopped.
"What?""
Lily looked down.
"He said if I told the counselor I wanted to live with him, everyone would stop arguing.""
I gently took her hand.
"What did you tell him?""
"I said I didn't want to.""
"And then?""
"He said I was being selfish.""
I swallowed.
"Did he threaten you?""
She nodded.
"He said if I didn't cooperate, Tara might have to send me away anyway.""
I pulled her close.
"Listen to me. You never have to say something that's not true to make adults happy.""
She buried her face against my shoulder.
"I don't want to go anywhere.""
"I know.""
For the next several minutes, we sat together.
Then Lily suddenly lifted her head.
"Dad?""
"Yes?""
"There's something else.""
She reached into her desk drawer and pulled out an old smartphone.
It was cracked across the screen.
"Where did you get this?""
"Emma gave it to me.""
I stared at the phone.
"Why?""
"She said I should listen to something before I trusted Tara.""
I looked at Lily.
"What's on it?""
She pressed the power button.
A recording appeared.
The date was three days earlier.
Lily pressed play.
Tara's voice came through the tiny speaker.
"If Marcus refuses to agree, we'll use the school reports. Daniel says we only need to make it look like Lily is unhappy and that Marcus can't manage her.""
Another voice answered.
Emma.
"But she isn't doing anything wrong.""
Tara sighed.
"She doesn't have to do anything. She just has to be in the right place when everything falls apart.""
Then Tara said something that made my blood turn to ice.
"Once Daniel gets guardianship, the trust can finally be handled properly. And Marcus won't be able to interfere.""
The recording ended.
I looked at Lily.
"Does Emma know you have this?""
She nodded.
"She said she didn't want to lie anymore.""
I listened again.
This time, I noticed something in the background.
A door opened.
A man's voice spoke.
Daniel.
"Did you tell her about the second document?""
Tara answered.
"Not yet.""
"Good. Because if Marcus finds out what Rachel actually signed, everything could fall apart.""
I paused the recording.
The second document.
I looked at Lily.
"Do you know what they were talking about?""
She shook her head.
But she reached into the back of the phone case and pulled out a tiny folded photograph.
It showed a document lying on Tara's desk.
The text was blurry, but the heading was readable.
*CHANGE OF BENEFICIARY AND TRUST CONTROL AGREEMENT.*

And at the bottom, beside a date from six months before Rachel died, was my signature.
Or something that looked exactly like it.
